Local Value, LLC DBA Vetsnear.me respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"). This page tells you how to report copyright infringement on vetsnear.me and how we respond.
1. Reporting infringement (DMCA Takedown Notice)
If you believe content on the Service infringes your copyright, send a written notice containing:
- A physical or electronic signature of the owner (or someone authorized to act on the owner's behalf).
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material claimed to be infringing, with enough detail to let us locate it — typically the URL.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on the copyright owner's behalf.
Send the notice to our designated DMCA agent:
Designated DMCA Agent Local Value, LLC 2305 Historic Decatur Road #100, San Diego, CA 92106 Email: dmca@vetsnear.me (preferred), with a copy to legal@vetsnear.me Subject line: "DMCA Notice"
Our designated agent is registered with the U.S. Copyright Office's Directory of Designated Agents as required by 17 U.S.C. § 512(c)(2).
We will investigate every notice we receive that contains the required information. Incomplete notices may be rejected without action.
2. Counter-notice
If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to the same address containing:
- Your physical or electronic signature.
- Identification of the material removed and the location at which it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, mailing address, telephone number, email, and a statement that you consent to the jurisdiction of the federal court in San Diego County, California, and that you will accept service of process from the original complainant.
If we receive a valid counter-notice we may forward it to the original complainant and, after 10–14 business days, restore the removed content unless the complainant files a court action.
3. Repeat infringers
We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers. For purposes of this policy, two or more substantiated DMCA notices against the same user within a rolling 12-month period may be considered a basis for termination, and we reserve discretion to act sooner where the conduct warrants it.
4. Safe harbor
The Service hosts user-submitted content (reviews, photos, listing edits, profile content) and also functions in part as an information-location tool by linking to third-party business websites. We assert the protections of 17 U.S.C. § 512(c) for user-stored content and 17 U.S.C. § 512(d) for linking and referencing functions, and we comply with the notice-and-takedown procedures required under each. We expeditiously remove or disable access to material identified in a valid notice.
5. False claims
Knowingly making a false DMCA claim (notice or counter-notice) subjects you to liability for damages under 17 U.S.C. § 512(f). When in doubt, consult an attorney before filing.
